Contact by Certified Mail Required for Labor Certification Cases - Another BALCA Decision

In Y.H. Park Olympic Taekwondow, Inc., 2000-INA-113, (BALCA, Jan. 8, 2002), the Employer claimed he had made telephone calls to contact U.S. workers. The employer did not send certified letters. Additionally, the Employer made inconsistent statements about the phone calls made and did not provide telephone bills. The decision is based on a previous precedent, M.N. Auto Electric, BALCA, 2000-INA-165 (August 8, 2001 (en banc)) where the Court expressed its preference for certified letters to be sent to each qualified job applicant during the recruitment period.
