USCIS Changes: I-130s Processed Only When Visa Available

On July 15, 2004, USCIS issued a Public Notice which states that it will only process Form I-130, Petition for Alien Relative, when a visa number is available. Before this policy change, a family member with an approved I-130 Petition had to wait until a visa number was available in order to adjust status or consular process. USCIS assures that this "will allow USCIS to concentrate resources first on cases where visas are actually available." For those who have already filed an I-130 Petition, this new policy will affect the processing times listed on the I-130 receipt notice, but it will not affect the visa number availability date, also referred to as the "priority date."
