AILA 2009 Conference Update on PERM Employment Based Green Cards - Labor Certifications

Increase in Random PERM Labor Certification Audits:
With increased PERM Audits, it is extremely important that companies maintain a compliance file in anticipation of an audit, which outlines and provides proof of all recruitment efforts made by the employer.

Increase in Supervised Recruitment by DOL:
Currently, DOL supervised 200 recruitment cases or more, but this number will increase. Employers need to get their mind set about it because they cannot make material changes to the application when supervised recruitment begins.

Company Lay-offs:
In dealing with the recent economic downturns, employers are faced with the decision to layoff workers. Employers with PERM Filings in route must notify and consider American workers in a related occupation, who have been laid off in the past six months before they may continue with the PERM Application
