State Contractors in KS to Submit IRCA Certificaton

Emily Haverkamp, Immigration Attorney at the Mdivani Law Firm: All contractors for the State of Kansas are required to submit a Certification that they comply with the Immigration Reform and Control Act (IRCA) with their contract bid. Contractors also agree to include the IRCA Certification in connection with any subcontracts under the State contract. It is important the all state contractors and subcontractors are aware of the certification requirement and read the certification statement carefully. It requires several things from Kansas state contractors and subcontractors, including:
* Properly completing the form I-9 for all new hires * Abiding by all state and federal immigration compliance laws * At the State's request, the Contractor is expected to produce to the State any documentation or other evidence to verify compliance
Any misrepresentation or employment of unauthorized workers constitutes a material breach of the contract and could subject the contractor to contract termination or damages.
