L-2 and J-2 Eligible for Work Authorization Should Obtain EADs from the INS
The INS indicated that L-2 and J-2s holders who are now eligible to work under January 17, 2002 law, should obtain Employment Authorization Documents from the INS prior to starting their employment in the U.S. No procedures have been set up yet - presumably, I-765s filed now will not be adjudicated until the INS received guidance from its Headquarters on how to adjudicate them. Thus, our advice to clients: call the office and talk to Mira Mdivani regarding the documents needed, but do not plan on having these filed for a while.
INS to Accept 10/13/98N Version of I-539 Through March 30, 2002
Because of delays in printing the recently revised Form I-539, Application to Extend/Change Nonimmigrant Status, the INS reports that it will continue to accept the 10/13/98N version of the form through March 30, 2002.
Attorney General Ashcroft Signs ‘T’ Visa Regulations
Attorney General John Ashcroft signed an interim regulation that sets forth application procedures for the new ‘T’ nonimmigrant classification, created by § 107(e) of the Trafficking Victims Protection Act of 2000 (TVPA).

DOS Requires New Form for Male NIV Applicants
A DOS cable released today is requiring all male NIV applicants between the ages of 16 and 45 to submit a supplementary Form DS-157, and also authorizes posts to require others to submit same form.

INS Increases Fees on February 19, 2002
This is a reminder to our clients of the INS will increase its filing/processing fees as of February 19, 2002. The new fees were published last month in Federal Register and will become effective on February 19, 2002; 60 days after publication. Spousal Work Authorization Awaits President's Signature
Just before adjourning, HR 2277 and HR 2278 (that provide work authorization to spouses of E and L visa holders respectively) was sent to the President for his signature. The President has not yet signed these bills. He is expected to do so shortly.
Guinea-Bissau Now Part of Embassy Lisbon's Consular District for NIV Purposes
Pursuant to 22 CFR 41.101, the Deputy Assistant Secretary of State for Visa Services has designated all of Guinea-Bissau to be part of Embassy Lisbon's consular district for purposes of issuing nonimmigrant visas.
