Rebekah will be leaving the firm in August to attend law school at the University of Kansas Law School. She will continue to work for the firm until August. We will miss her greatly, but we are very proud of her and wish her all the best.

USCIS Issues AC21 Portability Memo
In May 2005, USCIS issued a memo on I-140 and H-1B portability that James D. Eiss, Esq. has aptly called “exceedingly reasonable.” This memo discusses portability of I-140s filed concurrently with I-485s. The memo also discusses H-1B extensions beyond six years physical presence and provisions for the portability of H-1Bs.
H-1B Cap for Fiscal Year 2006 Not Yet Reached
As of June 16, 2005, USCIS advises that, despite rumors to the contrary, it has NOT reached enough fiscal year 2006 cap-subject H-1B petitions to be nearing the cap. In fact, unofficially, it has been indicated that petitions are coming in more slowly than had been predicted. However, it is still believed (again, unofficially) that the fiscal 2006 cap likely will be reached before the actual start of fiscal year 2006 on October 1, 2005.
