AILA opposes recent versions of a 245(i) extension that include new retroactive provisions requiring the ““familial or employment relationship”” to have existed prior to April 30, 2001 (in the House bill) or date of enactment (in the Senate bill).

WASHINGTON (AP) - The Immigration and Naturalization Service plans to raise fees for immigrants for services ranging from fingerprinting to obtaining green cards.

Labor Certification Process; Refiling Applications
|
The Employment and Training Admin.(ETA)of the Dept. of Labor (DOL) is amending its regulations relating to the permanent employment of aliens in the U.S. This final rule permits employers to request, in certain circumstances, that any labor certification application filed on or before Aug. 6, 2001, be processed as a reduction in recruitment request. ETA anticipates this will reduce the backlog of labor certification applications in State Employment Security Agencies (SESA's) thus reducing the processing time for both new applications and those currently pending.
The Immigration and Naturalization Service (INS) reports that, as of July 25, 2001, approximately 138,000 H-1B workers had been approved against the 195,000 limit for Fiscal Year 2001, which ends on September 30, 2001. In addition to the petitions already approved, INS has an estimated 39,000 pending petitions that may be counted against the H-1B cap. Not all pending petitions will ultimately count against the cap. Some petitions are denied, and some petitions are exempt from the cap; such as petitions approved for certain types of employers: for example, colleges, universities and non-profit research organizations.

INS Commissioner Nominee Confirmed by Senate

On July 31, President Bush's nomination of James W. Ziglar as INS Commissioner was confirmed by the Senate. Mr. Ziglar arrives at INS August 2. For those who are interested in knowing more about the new Commissioner, a biography on him is attached.

Hondurans and Nicaraguans Re-registration for TPS and EAD Extension Due August 6!

INS Reminds Eligible Hondurans and Nicaraguans to Re-register for Temporary Protected Status (TPS) and Employment Authorization Document (EAD) Extension. INS Service Centers must physically receive all completed re-registration applications for TPS by close of business on August 6, 2001.

Diversity Visa lottery (DV-2003) Availble in October!

The mail-in period for the next Diversity Visa lottery (DV-2003) will be held between noon on October 1, 2001 and noon on October 31, 2001. Section 203(c) of the Immigration Act of 1990 makes available up to 55,000 (1) permanent resident immigrant visas each year by random selection through a Diversity Visa lottery (DV-2003).

New N-400 Forms Fillable Online!

The INS Website has new N-400 forms that are fillable online. This form can be filled online, but cannot be filed via the Internet. You must print out the form and mail it to the appropriate INS office in order to file for naturalization.
