As of September 28, 2005, the U.S. will increase filing fees for appeals, motions to reopen, or motions to reconsider, from $110 to $385.

New Adress for MASTERS H-1B Fiilings After October 1, 2005
|
Until September 30, 2005, H-1B Petitions for beneficiaries with Master's degrees must be filed at USCIS Vermont Service Center, 1A Lemnah Drive, St. Albans, VT 05479-7001. Petitions with start dates of October 1, 2006 or later should be filed at the USCIS Service Center having jurisdiction over the place of employment.

OK To File H-1Bs for Master's Degree Holders

American Immgiration Lawyers Associaiton advised its members on August 25, 2005 that (despite rumors to the contrary) according to USCIS Headquaters, H-1B numbers are aill available for both fiscal 2005 and 2006 for graduates of U.S. masters or above programs.

DOL Proposed Rule on PERM to Eliminate Substitutions of Beneficiaries & 45 Days I-140 Filing Period

Departmet of Labor has proposed several changes to labor certification program (1) prohibition against substitution of alien beneficiaries on applications and approved labor certifications, and (2) a 45-day deadline for employers to file approved permanent labor certifications in support of I-140 petitions for Immigration Worker with the DHS. The rule is PROPOSED, not FINAL.

H-1B Cap for 2006 Is Reached
|
USCIS has issued a notice indicating that there are now sufficient cap-subject H-1Bs in the pipeline to fill the fiscal year 2006 quota--a fiscal year that does not even start until October 1, 2005. Petitions filed after August 10, 2005, will be rejected. Those received on that date will be subject to a "random selection process." Source: American Immigration Lawyers Association.

AILA Has Reason To Believe H-1B Cap Is Reached

AILA has notified its members that it has reason to believe that the H-1B cap for fiscal year 2006 has been reached, and that an announcement cutting off receipt of filings immediately, or perhaps even as of a date already past, is imminent. We will provide more specific information as soon as it is avilable.

H-1B Count for Fiscal 2006 Moves Closer to Cap

AILA repored on August 11, 2005 that USCIS showed an advance of approximately 3,000 H-1B numbers in four business days, and that the USCIS has, counting approved and pipeline cases, fewer than 6,300 numbers left for the fiscal year that starts October 1, 2005.
