Update re. TPS Venezuela - The Work Authorization Puzzle

The updates regarding TPS Venezuela are dizzying for employers; however, the latest guidance from USCIS on E-Verify and Venezuela TPS page show your employee, whether falling under TPS Venezuela 2021 or 2023 designation, may have an automatic extension of work authorization to November 2025, April 2026, or October 2026. The basics of the updates are as follows:
Automatic Extension of Work Authorization until 11/7/2025
EADs with a category A12 or C19 and a Card Expires date of Sept. 10, 2025; March 10, 2024; or Sept. 9, 2022, issued under the 2021 TPS designation of Venezuela, are automatically extended until Nov. 7, 2025 through action of Federal Register Notice.
Automatic Extension of Work Authorization until 4/2/2026
Venezuela 2023: EADs with a category A12 or C19 and a Card Expires date of April 2, 2025, issued under the 2023 TPS designation of Venezuela are automatically extended until April 2, 2026.
Venezuela 2021: EADs with a category A12 or C19 and a Card Expires date of Sept. 10, 2025; March 10, 2024; or Sept. 9, 2022 AND re-registered under the Jan. 17, 2025 Extension notice, are automatically extended until April 2, 2026. To demonstrate auto-extension, employees should present the I-821 Receipt Notice showing receipt date before Sept. 14, 2025.
Automatic Extension of Work Authorization until 10/2/2026
EADs with a category A12 or C19 and a Card Expires date of Sept. 10, 2025; March 10, 2024; or Sept. 9, 2022;
Re-registered under the Jan. 17, 2025 Extension notice, presents the I-821 Receipt Notice showing receipt date before Sept. 14, 2025; AND
I-765 Receipt Notice showing filing before 02/06/2025.
