What Employers Should Know About E-Verify Erroneous Issuance of Final Non-confirmation Notices

Employers need to know that a technical issue in E-Verify caused final non-confirmations to be issued erroneously between April 9, 2025 and May 5, 2025. E-Verify issued a notice on May 19, 2025 to alert employers of this technical issue. Employers should not take adverse action and should not terminate employment for individuals who received a Final Non-Confirmation during this time period.


What should employers do?

If employers determine they have cases affected by this E-Verify technical error, the guidance from E-Verify is that they should create a new case in E-Verify.
